National Association of Manufacturers (NAM) President and CEO Jay Timmons and Coalition for a Democratic Workplace (CDW) Chairman Geoffrey Burr announced today that the organizations will appeal the ruling of the U.S. District Court in their lawsuit against the National Labor Relations Board (NLRB) over its “Posting Requirement” rule.
“Manufacturers will appeal this decision on the numerous grounds available in order to reverse this unfair rule. The Board has grossly overstepped its authority, and the NAM will enter every arena necessary, including the courts, to protect manufacturers and rein in this rogue agency,” said Timmons.
Last week's decision did not properly account for the longstanding case and legislative history regarding NLRB authority that dates back to 1935. Additionally, the NAM will file for an injunction to prevent the posting notice from becoming effective prior to the appellate court's decision.
“The Board simply does not have authority to require this poster, and the Coalition for a Democratic Workplace will appeal this decision and continue to vigorously pursue a fair, full and correct legal remedy,” said Burr.
